Am I eligible?

You may be eligible for a Work Licence if being unable to drive is or would cause extreme hardship to yourself (not just an inconvenience) or undue hardship to others - such as your employer, employees, or dependents.

  • Extreme Hardship to yourself normally means that your disqualification will result in the loss of your job, business or livelihood. It can also include a need to get important places like to work or for medical reasons.

  • Undue Hardship to someone else is a lower threshold and includes hardship that your employer would face due to having to reshuffle staff, hire someone else to do the work that you are unable to do while disqualified, or their loss of income from you not being able to do your job fully.

  • Electricians, plumbers, builders, carpenters, roofers and all other trades and construction workers;

  • Farmers and other agricultural workers;

  • Transport and delivery drivers;

  • Sales and client facing roles;

  • Emergency and field services;

You are not eligible for a Work Licence if:

Unfortunately, you will not be eligible for a Work Licence if any of the following applies to you:

  1. You have produced a breath alcohol reading of over 800 mcg/L or a blood alcohol reading of over 160 ml/L;

  2. You have been indefinitely disqualified from driving;

  3. If you have been disqualified from driving any time in the past five years for any of the following reasons:

A)  Drink driving;

B)   Reckless or dangerous driving;

C)  Careless or inconsiderate driving causing injury or death;

D)  Failing to stop after an accident; or

E)   Applying for or obtaining a driver licence while disqualified from doing so.

4. You are indefinitely disqualified from driving;

5. You have been charged with driving while disqualified, suspended, or driving contrary to the terms of a limited licence; or

6. You are disqualified as a result of drink driving while operating a transport service vehicle and want to get limited licence to resume driving.

The 28 day stand-down period

Court Disqualification

If you are disqualified by the court then there is usually a mandatory 28 day “stand-down” period before the court will hear your limited licence application.

However, during this period we can get your application all ready and lodged with the Court so that it can be heard, and your Work Licence granted, as soon as the 28 day period ends.

Demerit Suspension

The stand down period doesn’t apply to demerit point suspensions meaning that we can lodge your application immediately.

If you think that you have incurred over 100 demerit points contact us immediately and we can have your WOrk Licence Application ready to lodge as soon as your suspension notice is received.
